These terms govern the purchase and use of the arcvoice desktop application and this website.

1. Provider
arcvoice is operated by Alexander Michler, Langacker 41A, 25560 Schenefeld, Germany. Contact: contact@arcvoice.ai. Further provider information is in the imprint.
2. Scope
These terms apply to every contract concluded through this website for the purchase of an arcvoice license. They also apply to the use of the desktop application and any updates we provide for it. Deviating terms of the customer do not apply unless we have agreed to them in writing.
3. Merchant of Record
Payments are processed by Lemon Squeezy (Lemon Squeezy LLC) acting as the Merchant of Record. The purchase contract for the payment is concluded between you and Lemon Squeezy. Lemon Squeezy handles invoicing, payment processing, sales tax, VAT and chargebacks. The underlying license to use the software is granted by us under these terms.
4. Conclusion of contract
The product pages on this website are an invitation to make an offer. You make a binding offer by completing the checkout. The contract is concluded when Lemon Squeezy confirms the order and we email you the license key. The contract language is English.
5. Price and payment
The price for an arcvoice license is shown on the pricing page and in the checkout. Prices include statutory VAT where applicable. The amount due is charged immediately at checkout by Lemon Squeezy. The invoice is issued by Lemon Squeezy.
6. License grant
Upon payment we grant you a non-exclusive, non-transferable, worldwide license to install and use arcvoice on up to three devices you own or control, for personal or internal business use. The license is perpetual and includes all future updates to the application released by us.

7. Restrictions
You may not: sublicense, rent, lease, lend or resell the application; remove or alter copyright notices; reverse-engineer, decompile or disassemble the application except to the extent permitted by mandatory law; use the application to build a competing speech-to-text product; or share your license key with third parties. Open-source components shipped with the application remain subject to their own licenses, listed inside the application.
8. Updates and support
Lifetime updates are included with the license. We may change, improve or discontinue individual features over time. We do not guarantee that any specific feature will be available indefinitely. Support is provided by email on a best-effort basis and is limited to the current major version of the application.
9. Right of withdrawal and refund
Consumers in the European Union have a statutory right of withdrawal. The full instructions and the conditions under which the right expires are set out on the refund and cancellation page. Independently of the statutory right, we offer a 30-day money-back guarantee — write to contact@arcvoice.ai within 30 days of purchase and we will refund the order.
10. Warranty
Statutory warranty rights for consumers apply unrestricted. For contracts with businesses, the limitation period for warranty claims is twelve months from delivery of the license. The software is provided as a standardised product, not customised to individual customer specifications.
11. Liability
We are liable without limitation for damages arising from injury to life, body or health, for damages caused by intent or gross negligence, and under the German Product Liability Act (Produkthaftungsgesetz). For damages caused by ordinary negligence, we are liable only if a material contractual obligation (an obligation whose fulfilment is essential to the proper performance of the contract and on whose observance the customer regularly relies) has been breached. In that case liability is limited to damages typically foreseeable at the time of conclusion of the contract. Further liability is excluded.

How we handle personal data is described in the privacy policy.
13. Consumer dispute resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board within the meaning of the German Consumer Dispute Resolution Act (VSBG).
14. Governing law and venue
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law does not deprive the consumer of the protection afforded by mandatory provisions of the law of the country in which the consumer is habitually resident. The place of jurisdiction for disputes with merchants, legal persons under public law or special funds under public law is Hamburg, Germany.
15. Severability
If any provision of these terms is or becomes invalid, the validity of the remaining provisions is not affected. The invalid provision will be replaced by a valid provision that comes as close as possible to the original economic purpose.
16. Changes to these terms
We may update these terms to reflect changes in the product or in the law. The version that applies to your purchase is the version in force on the day you completed checkout. Material changes for ongoing relationships will be announced by email at least 30 days before they take effect.
